Motorcycle Injury Lawyer in San Antonio: Rider Injuries, Trauma Care and What Decides a Claim’s Value

This page is from LAWBOSS – Uvalle Law Firm, PLLC, the firm behind Motorcycle Lawyer San Antonio. A rider has no frame around them, so the injuries from a motorcycle crash are usually worse than those from a car crash at the same speed, and they last longer. This page explains the injuries we see most, where serious injuries are treated in San Antonio, who pays the medical bills while a claim is open, and what Texas law lets an injured rider recover.

What riders ask most

Riders want to know what their claim is worth. We do not quote averages or other people’s results, because they say nothing about your case. What we can do is explain the factors that decide value, and once we know your injuries, your treatment and the insurance involved, tell you how we see your claim.

Why rider injuries are so serious

TxDOT’s motorcycle safety campaign reports that in 2025, 557 riders lost their lives and 2,468 were seriously injured in crashes in Texas. Its separate crash facts for 2025 count 559 motorcyclists, operators and passengers, killed, and say 31 percent of them were not wearing helmets. In Bexar County alone, TxDOT’s 2025 county table lists 759 people with suspected serious injuries in crashes of every kind. Behind each of those numbers is a long recovery.

Road rash

Sliding on asphalt strips skin, and deep road rash is a wound, not a scrape. It can carry gravel and debris into the tissue, become infected, need cleaning under anaesthesia or skin grafts, and leave permanent scarring. Disfigurement is a separate item of damages in Texas, so photographs taken as the wounds heal matter.

Fractures

Legs, ankles, wrists, collarbones, ribs and the pelvis break most often, as the rider is thrown or the bike comes down on a leg. Many need surgery with plates, rods or screws, and some need more surgery later. A fracture near a joint can bring arthritis years afterwards, which is why future care has to be part of the claim.

Brain injuries

A helmet reduces the risk of a head injury but does not remove it. A concussion or other traumatic brain injury can follow even when the helmet did its job. The signs are often missed in the emergency room: headaches, trouble concentrating, memory gaps, irritability, sleep problems, sensitivity to light. Tell your doctor about every one of them, and ask the people close to you what they have noticed.

Spinal cord and back injuries

Herniated discs, vertebral fractures and spinal cord injuries change how a person works and lives. A spinal cord injury can bring partial or full paralysis and a lifetime of care. In these cases the claim has to account for decades of medical needs, equipment, home changes and lost earning capacity.

Internal injuries, amputations and burns

Blunt impact can injure organs without much showing on the outside. A crushed limb may not be saved. Contact with the engine or exhaust, or a fire, can cause burns. Each of these carries its own treatment and its own long-term costs.

Trauma care in San Antonio

Serious crash injuries in San Antonio are taken to one of two Level I trauma centres. University Hospital, at 4502 Medical Drive, is described by University Health as the region’s only Level I trauma centre for both adults and children, verified by the American College of Surgeons. Brooke Army Medical Center, at Joint Base San Antonio-Fort Sam Houston, is the only Level I trauma centre in the Defense Department, and the Army says about 85 percent of its trauma admissions are community members without military affiliation. A rider hit on Loop 1604 or I-35 may go to either.

After the trauma stay, care often moves to an orthopaedic surgeon, a neurologist, physical therapy, pain management and sometimes inpatient rehabilitation. Keep a list of every provider and every visit. It becomes the backbone of the medical part of your claim.

Who pays the medical bills while the claim is open

The other driver’s insurer does not pay bills as they come in. It pays once, when the claim is resolved. Until then, the bills are paid from other sources:

  • Your health insurance or health plan. It pays under its own terms, and it may have a right to be repaid from your recovery.
  • Personal injury protection. If your policy carries PIP, Insurance Code Section 1952.155 says it pays without regard to fault, and Section 1952.156 says benefits are due within 30 days after the insurer receives satisfactory proof of the claim.
  • Medical payments coverage, if your motorcycle policy includes it.
  • Hospital liens. A hospital that admits you within 72 hours of the crash has a lien on your claim under Property Code Section 55.002, secured by a notice filed with the county clerk under Section 55.005. Section 55.004 limits how much the lien can claim.
  • Medicare, Medicaid and military coverage. Each may have a right to be repaid, and each has its own process.

Texas law also limits what can be claimed for medical expenses to the amount actually paid or incurred by or on behalf of the injured person, under Civil Practice and Remedies Code Section 41.0105. That is why we collect the payment records, not just the bills. Our page on dealing with the insurance companies explains each coverage in more detail.

What Texas law lets an injured rider recover

Texas divides compensatory damages into two kinds. Economic damages, under Section 41.001, compensate actual economic or pecuniary loss. Noneconomic damages compensate physical pain and suffering, mental or emotional pain or anguish, disfigurement, physical impairment, loss of enjoyment of life and other losses that are not financial.

Kind of damagesWhat it covers
Medical expensesWhat was paid or incurred for care so far, and the care your doctors expect you to need
Lost earningsWages and income lost while you were hurt and recovering
Lost earning capacityThe loss of your ability to earn in the future, when an injury is lasting
Physical pain and mental anguishPast and future, as the evidence shows them
Physical impairmentThings you can no longer do, or do the way you did
DisfigurementScarring and visible changes, from road rash, surgery or amputation
PropertyThe motorcycle, the helmet, riding gear and other property damaged

What decides the value of an injury claim

Search engines are full of questions about the average motorcycle settlement in Texas, how much you can sue for, and how much compensation a rider gets. The honest answer is that the figure depends on the facts, and these are the facts that matter most:

  1. How serious and how lasting the injury is. A fracture that heals fully, a fracture that leaves arthritis, and a brain injury that ends a career are three very different claims.
  2. The medical evidence. Clear records, consistent treatment and a doctor who can explain future care carry weight. Gaps in treatment are used against riders.
  3. Your work and your age. Lost income depends on what you did and for how long you could have done it.
  4. How the injury changed your life. Pain, anguish and impairment are proved by your own account and by the people around you.
  5. The fault split. Every percentage of responsibility a jury would give the rider is taken off the damages under Section 33.012, and more than 50 percent bars recovery under Section 33.001.
  6. The insurance available. The at-fault driver’s limits, any other responsible party, and your own uninsured and underinsured motorist coverage often set the practical ceiling of what can be collected.
  7. The liens. What has to be repaid to a hospital or health plan affects what reaches you, and liens can sometimes be reduced.

That is also why we do not settle a serious claim before the injuries are understood. A release is final. If a second surgery is needed after you have signed, it cannot be added later.

Exemplary damages

Exemplary damages punish rather than compensate. Under Section 41.003 they may be awarded only on clear and convincing evidence that the harm resulted from fraud, malice or gross negligence, and only if the jury is unanimous. A driver who was drunk, or who drove with conscious indifference to the danger, may face them. Section 41.008 caps exemplary damages in most cases, but Section 41.008(c) takes certain felonies out of the cap, including intoxication assault and intoxication manslaughter.

The deadline

Suit for a personal injury must be filed within two years of the crash under Section 16.003. For an injured rider or passenger under 18, Section 16.001 does not count the time before the 18th birthday. A claim against a government body needs written notice within six months under Section 101.101. If someone was killed in the crash, the family’s claim is a different kind of case, and LAWBOSS handles wrongful death claims too.

Questions people ask

How much is my motorcycle injury claim worth?

It depends on the injury and its future, the medical care, lost income, how the injury affects your life, the fault split and the insurance available. We do not quote averages; once we know those facts, we can tell you how we see your claim.

Can I still recover if I was not wearing a helmet?

Yes. A missing helmet does not cause a crash. The insurer may argue it made a head injury worse, but it needs evidence for that, and it does not affect injuries to the rest of the body.

Who pays my hospital bill from University Hospital or BAMC?

At first, your health insurance or other coverage, if you have it. The hospital may also file a lien on your claim under Property Code Chapter 55, which is paid when the claim is resolved.

Can I claim for scarring from road rash?

Yes. Disfigurement is a recognised element of damages in Texas. Photographs of the wounds as they heal help prove it.

What if my injuries get worse after I settle?

A signed release usually ends the claim for good, which is why we wait until your injuries and future care are understood before resolving a serious claim.
